Inspekta Mwala Sues Coca-Cola

Veteran Kenyan comedian Davis Mwabili Hezron, popularly known as Inspekta Mwala, has moved to court accusing beverage giant Coca-Cola and actress Jacky Vike of trademark infringement.

In a Notice of Motion filed before the High Court, Mwabili is seeking urgent legal intervention against Coca-Cola Central East and West Africa Limited and Coca-Cola Beverages Kenya Limited, alongside Vike.

Dispute Over “Ka-Mwala” Phrase

At the centre of the dispute is the use of the phrase “ka-mwala” in the “Kachingching na Coke” advertising campaign.

Mwabili argues that the term is confusingly similar to his registered trademark “Mwala,” a name that has defined his comedy brand for decades.

He says the brand dates back to the 1990s and was officially registered in 2010, becoming widely recognized through popular productions such as Vitimbi and Inspekta Mwala.

Claims of Public Confusion

According to court documents, the dispute stems from a promotional video shared by Vike in May 2024 across social media platforms.

In the clip, “ka-mwala” is used to refer to a 200ml Coca-Cola soda bottle.

Mwabili contends that the phrase is both phonetically and conceptually similar to his trademark, potentially misleading the public into believing he is associated with the product.

He further claims that confusion has already occurred, with fans allegedly reaching out to ask whether he is part of the campaign.

Legal Demands Filed in Court

Through the application, Mwabili is seeking several court orders, including:

  • Immediate injunction to stop use of “ka-mwala” in promotions
  • Removal of all related content from digital platforms
  • Disclosure of profits earned from the campaign
  • Additional protections for his intellectual property rights

He argues that continued use of the phrase allows the respondents to commercially benefit from his long-established brand while weakening its distinct identity.

Longstanding Media Presence

Mwabili’s case heavily leans on his decades-long visibility in Kenyan media.

His work has been featured on platforms such as Kenya Broadcasting Corporation (KBC) and Citizen TV, helping cement “Mwala” as a household name.

Campaign at the Center of Controversy

The “Kachingching na Coke” campaign, launched in May 2024, was a major promotional drive by Coca-Cola.

It reportedly featured cash prizes totaling Ksh163 million and relied heavily on influencer-driven digital marketing, with Vike among its most visible faces.
