Kileleshwa MCA Robert Alai has broken his silence following allegations that he is illegally occupying a prime parcel of land in Runda, Nairobi. In a strongly worded statement released on June 30, the outspoken county legislator hit back at the landowner and his lawyer, accusing them of orchestrating a smear campaign designed to prejudice ongoing court proceedings.

Alai stated that the accuser, who has claimed ownership of the disputed land for over 33 years, has turned to social media attacks, media trials, and character assassination instead of allowing the case to be determined through proper legal channels.

Online Allegations and Viral Video

The dispute came into the public spotlight after a viral video surfaced online showing the alleged landowner and his lawyer accusing Alai of forcibly occupying their property. In the footage, the visibly agitated investor alleged that he had been forcibly removed from his land by individuals linked to the MCA, claiming he was physically assaulted during the altercation.

The lawyer further claimed that despite court proceedings being active, Alai and his associates had entered the property, erected structures, and were attempting to evict the rightful owner through intimidation and force.

Alai’s Response: “Smear Tactics Won’t Work”

In response, Alai said he felt compelled to speak publicly due to the “persistent campaign of trolling, defamation, bullying, and public shaming” that he claims has been engineered by the accuser, his legal counsel, and even mainstream media, particularly The Standard newspaper.

“I am compelled to speak out due to the persistent campaign of trolling, defamation, bullying, and public shaming orchestrated,” said Alai in his statement.

He emphasized that the matter is already before the courts, and warned that any attempts to influence the outcome through media manipulation and public pressure undermine the integrity of the judicial system.

“Let the Court Decide,” Says Alai

Alai maintained that he has fully complied with all court procedures and that the matter should be determined solely based on legal merit, not emotion or public opinion.

“The matter is sub judice, and your grievances must be prosecuted within the confines of the courtroom, not through media trials or social media lynching,” he added.

He warned that continuing the alleged campaign of defamation and cyberbullying could expose the investor and his legal team to potential counter-litigation, citing Kenya’s Defamation Act and the Computer Misuse and Cybercrimes Act.

Counter-Accusations: “Hired Goons and Court Bullying”

In a surprising twist, Alai also made counter-accusations, alleging that the same investor had previously hired 500 goons to destroy property on the disputed land, even as the matter remained under judicial review.

He further claimed that the accuser had attempted to coerce at least six other individuals into participating in illegal activities, including harassment and efforts to influence court officials to rule in his favor.

“You have approached no less than six individuals in attempts to perpetrate your illegalities and influence judicial officers,” Alai stated. “That in itself reflects a lack of faith in the court process.”

Alai urged the complainant to cease what he called ‘unethical tactics’ and instead prepare a solid legal defense for the matter before the court.

The Legal Framework: What the Law Says

Kenya’s Defamation Act criminalizes both libel (written defamation) and slander (spoken defamation), especially when aimed at damaging another person’s reputation maliciously.

Similarly, under the Computer Misuse and Cybercrimes Act (2018):

  • Publishing false information with intent to defame or harass is punishable.
  • Cyberbullying and online harassment carry criminal liability and possible jail terms.

If Alai’s legal team proceeds with counter-litigation, the case could expand into civil and criminal territory, involving digital forensics, media evidence, and witness testimonies from both online and offline interactions.

A Longstanding Land Ownership Claim

The complainant maintains that he has legally owned the parcel in Runda for 33 years, with title documentation to support his claim. His legal team argues that Alai and his associates are trespassing, and that his client was forced out of his own property without proper judicial authorization.

The land, located in the affluent Runda neighborhood, is said to be valued at hundreds of millions of shillings, raising the stakes in what is becoming a highly publicized property dispute.

Public Reactions: A Divided Debate

The controversy has sparked a divided response from Kenyans online, with some defending Alai and accusing the complainant of weaponizing social media, while others are calling for Alai’s immediate resignation and investigation over what they see as abuse of office and intimidation tactics.

“Why is every land case in this country ending up in smear campaigns instead of the courtroom?” one user posted on X (formerly Twitter).

“If Alai has the truth on his side, he should focus on court proceedings, not PR rebuttals,” another user added.

Meanwhile, some have raised concerns about the media’s role in shaping the narrative, especially as both sides accuse each other of using news outlets to sway public opinion.
