Paul Otuoma, the Governor of Busia County, is facing a major legal battle after a petitioner filed a lawsuit seeking Ksh100 million in damages over alleged assault and intimidation claims.

The petition, lodged at the Milimani High Court, accuses the county boss of gross misconduct following an incident that reportedly occurred on March 6, 2026.

Details of the Alleged Incident

According to court documents, the incident took place at Bukri Market in Funyula Constituency during an official county event.

The petitioner, identified as 31-year-old boda boda rider Yusuf Suleiman Hamisi, claims he was attacked while standing in line to receive certified maize seeds distributed by the county government.

The lawsuit alleges that Governor Otuoma kicked him in the groin without provocation in full view of members of the public. The incident was reportedly captured on video and widely circulated on social media, further fueling public outrage.

Claims of Intimidation and Medical Obstruction

Through his lawyer Danstan Omari, the petitioner further claims that Hamisi faced significant challenges when seeking medical treatment.

He alleges that attempts to receive care at Sioport and Ruambo Sub-County hospitals were obstructed, with claims linking the interference to the governor’s office.

The matter was later reported at Sioport Police Station. However, the petition claims that shortly after filing the report, the victim began receiving threats from unknown individuals.

Allegations of Threats and Abduction

The court filings paint a disturbing picture, alleging that unidentified individuals visited Hamisi’s home and pressured him to withdraw the complaint.

The petitioner further claims that he was briefly abducted before managing to escape, after which he reportedly went into hiding over fears for his safety.

The petition argues that the alleged actions violated several constitutional rights, including:

  • The right to dignity
  • The right to security of the person
