Moving Ahead Following SHIF Suspension

The National Health Insurance Fund Continues Amidst Legal Disputes

The Social Health Authority (SHA) has assured Kenyans that the National Health Insurance Fund (NHIF) will continue providing financial services for health services following a recent High Court ruling. The court suspended the newly instituted Social Health Insurance Fund (SHIF), causing a temporary halt in its services.

NHIF to Bridge the Gap

In a statement released on Wednesday, SHA clarified that NHIF would continue to cater to all paid-up and eligible members. This decision ensures that there will be no disruption in health financing while the court’s stay order is in effect. The statement emphasized, “Pending the lifting of the Court orders and within the 45-day-stay order period, the National Health Insurance Fund (NHIF) services will continue to be availed to all paid-up and eligible members.”

SHA highlighted that NHIF’s current framework would remain operational, fulfilling its obligations to health facilities as per existing contractual agreements. This move aims to maintain stability within the health sector during this transitional period.

SHA’s Commitment to Honoring NHIF Obligations

SHA reassured the public that NHIF would honor all its commitments. “We want to reassure you that all NHIF obligations will be honoured as per existing contracts with service providers and Fund members,” the SHA stated. This reassurance aims to alleviate any concerns about potential disruptions in healthcare services due to the legal tussle.

Continued Push for SHIF Registration

Despite the temporary setback, SHA continues to advocate for the registration of Kenyans to the SHIF. The organization emphasized that preparatory activities for SHA’s successful implementation would proceed as planned. These activities include membership registration, validation of benefit packages, contracting health facilities, and market sensitization, including public education. These efforts are designed to ensure effective public participation and readiness for SHIF once the court orders are resolved.

High Court Ruling and Its Implications

The High Court’s suspension on July 12 followed its declaration that the SHIF was unconstitutional. The suspension was implemented for 45 days after the ruling, responding to concerns raised by the Attorney General’s office. The AG argued that repealing the SHIF without a proper transition would create confusion and a void in the health sector, adversely affecting many Kenyans.
